Welcome to ndexr.io. By accessing or using our services, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By using ndexr.io, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

2. Description of Service

ndexr.io is a cloud infrastructure management platform built on R and Shiny. It provides tools for provisioning, managing, and monitoring AWS resources including EC2 instances, Route 53 domains, security groups, and related services. Access to features depends on your subscription tier.

3. Accounts and Authentication

You must sign in using Google OAuth. You are responsible for the security of your Google account.
Provide accurate information and keep it up to date.
You are responsible for all activity under your account.
Notify us immediately if you suspect unauthorized access.

4. User Responsibilities

AWS Costs

You are responsible for all AWS costs incurred through infrastructure you provision via ndexr.io. We do not control AWS pricing and are not liable for unexpected charges. Monitor your AWS billing dashboard independently.

Acceptable Use

You may build anything you like on infrastructure managed through the platform. You agree not to use ndexr.io to compete directly with ndexr.io itself, or to redistribute platform code or infrastructure tooling derived from it.

Compliance

You are responsible for ensuring your use of AWS resources complies with applicable laws, AWS Acceptable Use Policy, and any relevant regulations.

Credentials

If you provide AWS credentials, you are responsible for ensuring they have appropriate permissions and are rotated as needed.

5. Subscription Plans and Payments

Subscription fees are billed through Stripe on a recurring basis.
No refunds except as required by law.
We may change pricing or features with 30 days notice. Cancel before changes take effect if you disagree.
Free-tier accounts may have usage limits. We reserve the right to modify free-tier availability.

6. Intellectual Property

All content, code, trademarks, and logos on ndexr.io are the property of ndexr or its licensors. You may not copy, modify, or redistribute platform code without prior written consent. Infrastructure and applications you build using the platform remain yours.

7. Termination

We may suspend or terminate your account for violation of these terms, abusive behavior, or non-payment. Upon termination:

Your access to the platform will be revoked.
We are not responsible for preserving your data after termination. Infrastructure on your AWS account is unaffected.
You may request data export before termination by contacting us.

8. Limitation of Liability

To the maximum extent permitted by law, ndexr.io will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the platform, including:

Lost data or downtime.
AWS infrastructure issues, billing disputes, or outages beyond our control.
Actions taken by third-party services (AWS, Google, Stripe).

Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

ndexr.io is provided "as is" and "as available." We make no warranties regarding uptime, availability, or fitness for a particular purpose. Short maintenance windows may occur. We do not guarantee the platform will be uninterrupted or error-free.

10. Changes to Terms

We may update these terms at any time. Material changes will be posted with an updated effective date. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, USA. Any disputes shall be resolved in the courts located in Colorado.
